This Privacy Policy describes how LumosArt ("we", "us", or "our"), operated by Aleksei Egin, a physical person, collects, uses, and discloses your information. We are committed to protecting your privacy and handling your data transparently. This policy applies to all users of the LumosArt application ("Application") on both Android and iOS platforms.

1. Age Restriction

LumosArt is not recommended for individuals under the age of 16. We do not knowingly collect personal information from children under 16. If you are under 16, please do not use the Application or provide any personal information to us.

2. Information We Collect

When you use LumosArt, we collect the following information:

• Email: To create and manage your account.

• OAuth ID: For authentication purposes when you sign in with an external account.

• User IDs: To identify your account in our system.

• Photos: When you upload them to the Application.

• Application Usage Data: Includes pages of the Application that you visit, the time and date of your visit, and the time spent on those pages.

• Crash Reports: To improve the Application's stability and performance.

• Operating System: The operating system of your mobile device to ensure compatibility and optimize the Application's performance.

3. How We Use Your Information

Your information is used to:

• Provide, operate, and maintain the Application.

• Improve, personalize, and expand the Application.

• Understand and analyze how you use the Application.

• Develop new products, services, features, and functionality.

• Communicate with you, including for customer service, to provide you with updates and other information relating to the Application, and for marketing and promotional purposes.

• Send you emails.

• Find and prevent fraud.

4. Sharing Your Information

We may share your information with third-party services that we use to support our Application. These services include:

• Firebase: For backend services. Firebase Privacy Policy

• RevenueCat: For managing in-app purchases and subscriptions. RevenueCat Privacy Policy

We do not sell your personal information to third parties.

5. How We Process, Share and Retain Your Photos and Image Data

We process your photos to provide you with the features of the LumosArt application that you choose to Use. In doing so, when you upload photos to LumosArt, we process your photos using technology that identifies data that is in the photos and provides us with information, such as information about your facial position, orientation and topology (“Face Data”), and other elements of your photo (collectively, “Image Data”).

The following describes how we process, share, and retain your photos, videos and Image Data in connection with various features of the LumosArt app.

• Avatars: To generate Avatars, you must upload 1-4 photos to LumosArt and select a gender to be associated with the Avatar. The photos you upload are stored on our servers, which are hosted by Cloudflare, Inc. The Avatars feature relies on the Stable Diffusion model. We create a copy of the Stable Diffusion model, which is hosted on our replicate.com servers, and apply technology that do not retrains the model using the photos you uploaded and generates Image Data to create and personalize your Avatars. After the successful generation of Avatars, your Face Data is deleted permanently from our servers. We do not Use your Personal Data or Image Data to train and/or create separate artificial intelligence/products.
  It’s possible to delete photos by doing the following steps:
  
  • Open the LumosArt app
  • Select avatar style
  • Click “Continue” button
  • Click three dots icon in the upper right corner
  • Click “Hold to delete all” button

Please be aware that deleting the LumosArt application from your device does not result in the deletion of your LumosArt account!

6. Data Security

We strive to use commercially acceptable means to protect your information. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee its absolute security.

7. User Rights

You have the right to access, correct, or delete your personal information. You may also have the right to restrict or object to the processing of your information. To exercise these rights, please contact us at [email protected].

8. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Application, prior to the change becoming effective.

10. Disclaimer of Warranty and Limitation of Liability

LumosArt is provided on an "as is" and "as available" basis without any warranties, express or implied, of any kind regarding accuracy, reliability, or availability. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Aleksei Egin, as the operator of LumosArt, assumes no responsibility for errors or omissions in the contents of the Application, for any downtime or loss of data, or for any form of loss or damage suffered as a result of the use of the Application. This includes, but is not limited to, direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.

Your use of LumosArt is at your sole risk and discretion. You are solely responsible for any damage to your device or loss of data that may result from accessing or using the Application. No advice or information, whether oral or written, obtained by you from us or through the Application will create any warranty not expressly stated herein.

We do not warrant that the Application will operate error-free or that the Application and its servers are free of computer viruses or other harmful mechanisms. If your use of the Application results in the need for servicing or replacing equipment or data, we are not responsible for those costs.

By using LumosArt, you acknowledge and agree that the limitations of liability set out in this privacy policy are reasonable and that they are a fundamental element of the basis of the bargain between Aleksei Egin and you, the user. LumosArt would not be provided without such limitations.
